DECONSTRUCTING THE MEAGRE PROCUREMENT OF LEGAL HELP: A CALL FOR REFORM

The poor procurement of legal help results from the culture of crime concealment and victim blaming practiced in our society. These social practices simultaneously suppress the process of justice while acting as an impetus for criminals. It is the constitutional rights of the citizens to have access to justice and to be treated equally before the law provided by Article 27 and 31 of the Constitution of Bangladesh. However, various factors obtuse the enthusiasm to seek legal help from law enforcement authorities. Despite the tireless efforts of the Government and the legislature to encourage the procurement of legal help, and ensure social welfare and justice through various legal developments, people tend to shy away from the justice process often because of the probability of facing backlashes. The impression of shame and the idea of honour unkenneled by society incentivize this action. The efforts to provide prompt help to the citizens and promote their right to access justice are often countermanded by multiple drawbacks. If people are bound to think about damage and loss before reaching for help, it is an ignominy that is gradually developed by amalgamating many problems. Inventing and taking efficient measures to tackle these issues is the demand of time. A small statistic that includes general people as participants, national statutes, international instruments, newspaper articles, official reports by international organizations, websites, and books are the main sources of information used to analyze various cases. The objective is to dissect some of the most frequent crimes and to perceive multiple difficulties in procuring legal help. This article provides evidence of the effect of social silence and suggests some legal developments and motivators for this phenomenon to change.
